TuningBot User Agreement for ECU Tuning Services

1. Allgemeine Bestimmungen
1.1. Tuningbot.com (hereinafter referred to as “TUNINGBOT”) provides Internet users (hereinafter referred to as the “User”) with access to its online services under the terms and conditions of this User Agreement (hereinafter the “Agreement” oder “User Agreement”).
This Agreement becomes effective once the User expressly accepts its terms as provided in Clause 1.4 below.
1.2. TUNINGBOT offers services including, but not limited to, the uploading, analysis, and modification of files. All currently available services, as well as any future developments or additions, are subject to this Agreement.
1.3. The use of TUNINGBOT services is governed by this Agreement, the Privacy Policy, and any additional terms applicable to specific services.
TUNINGBOT may amend this Agreement at any time. Updates shall take effect upon publication on the website, unless otherwise specified in the new version.
1.4. By accessing or using any TUNINGBOT service, or by completing registration, the User confirms full and unconditional acceptance of this Agreement.
If the User disagrees with any part of this Agreement, they must refrain from using TUNINGBOT services.
If the Agreement is amended and the User does not accept such changes, the User must discontinue all use of TUNINGBOT services.
2. User Registration and Account
2.1. Certain TUNINGBOT services or features require registration and the creation of a unique User account.
2.2. During registration, the User must provide accurate, complete, and up-to-date information. Failure to do so may result in suspension or deletion of the account. TUNINGBOT reserves the right to block or restrict any account that contains false, incomplete, or misleading information.
2.3. TUNINGBOT may at any time request verification of the information provided and supporting documentation. Failure to comply may result in account suspension or deletion.
If the submitted documents do not match the registration data or do not allow proper identification of the User, TUNINGBOT reserves the right to deny access to the account.
2.4. Personal data provided by the User will be processed in accordance with the TUNINGBOT Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR).
2.5. Access Credentials:
Upon registration, the User shall provide a valid email address (used as the login) and password.
TUNINGBOT may prohibit certain usernames and set password requirements (length, symbols, etc.).
2.6. The User is solely responsible for maintaining the confidentiality of their login credentials and for all activities performed through their account. Any actions made through the User’s account shall be deemed performed by the User, unless the User has duly notified TUNINGBOT of unauthorized access in accordance with Clause 2.7.
2.7. The User must immediately inform TUNINGBOT of any unauthorized access or suspected breach of account security.
For safety, the User should log out after each session. TUNINGBOT shall not be liable for any losses resulting from the User’s failure to comply with these requirements.
2.8. Account Use:
The User may not reproduce, duplicate, copy, sell, resell, or exploit any part of TUNINGBOT’s services for commercial purposes unless expressly authorized in writing by TUNINGBOT.
2.9. Account Suspension or Termination by TUNINGBOT:
TUNINGBOT may block or delete a User’s account, restrict access, or remove content at its sole discretion, including in cases of inactivity, violation of this Agreement, or breach of applicable laws.
2.10. Account Deletion by the User:
The User may request account deletion at any time by contacting TUNINGBOT support at info@tuningbot.com.
3. General Usage and Storage Rules
3.1. TUNINGBOT may impose limitations on service usage, including storage periods, file size limits, daily usage quotas, and regional availability.
TUNINGBOT may also restrict automated requests (bots, scripts, crawlers) to protect system integrity.
3.2. TUNINGBOT may send informational or promotional communications to Users, in compliance with applicable data protection and marketing laws.
4. Benutzerinhalt
4.1. The User is solely responsible for all content uploaded, transmitted, or processed through TUNINGBOT services and must ensure that such content complies with applicable laws, including intellectual property and data protection regulations.
4.2. The User grants TUNINGBOT a non-exclusive, royalty-free, worldwide license to process, store, reproduce, and technically modify the uploaded content as necessary to operate and improve the service.
5. Service Use Conditions
5.1. The User is responsible for all actions related to their use of the service and for any violations of the rights of third parties.
5.2. The User must not:
- Violate any laws or third-party rights, including the rights of minors;
- Impersonate any individual or representative of an organization without proper authorization;
- Attempt to bypass or assist others in bypassing restrictions or prohibitions established by this Agreement;
- Engage in any unlawful or unethical activity.
5.3. To process a file, the User must create a specific processing task (hereinafter – “Processing Task”).
6. Intellectual Property
6.1. All materials available through TUNINGBOT services — including design elements, ECU data, software, databases, text, graphics, videos, and other content — are protected by copyright and other intellectual property laws.
All rights not expressly granted to the User remain the property of TUNINGBOT or respective rights holders.
7. Limitation of Liability
7.1. The User uses TUNINGBOT services at their own risk. Services are provided “as is”, without any warranty of any kind.
7.2. TUNINGBOT does not guarantee that services will meet the User’s expectations or operate without interruption, error, or delay, or that results obtained through the services will be reliable or suitable for any specific purpose.
7.3. Any information, ECU files, software, or materials obtained through TUNINGBOT are used at the User’s sole risk. TUNINGBOT shall not be liable for any direct or indirect damage to equipment, vehicles, or data resulting from their use.
7.4. TUNINGBOT shall not be liable for any losses, damages, or claims arising from the use or inability to use its services.
7.5. Users who wish to report a problem with service quality must contact the support team via the ticket system.
8. Miscellaneous Provisions
8.1. This Agreement constitutes the entire agreement between the User and TUNINGBOT regarding the use of services and supersedes any prior agreements.
8.2. Nothing in this Agreement shall be interpreted as establishing any partnership, joint venture, employment, or agency relationship between the parties.
8.3. If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8.4. Failure by TUNINGBOT to enforce any provision of this Agreement shall not constitute a waiver of its rights to enforce it later.
8.5. This Agreement shall be governed by and construed in accordance with the laws of Italy. Any dispute arising from or relating to this Agreement shall be submitted to the exclusive jurisdiction of the courts of Pescara, Italy.
9. Refund, Credit, and Warranty Policy
9.1. The User may submit a claim regarding file processing quality within 30 days from the payment date.
Guarantees apply only to operations performed on original, unmodified files.
9.2. Claims must be submitted through the support ticket system.
9.3. The User must provide detailed information, including a description of the issue, screenshots, photos, and any relevant evidence. Upon TUNINGBOT’s request, the User must supply additional data.
9.4. TUNINGBOT reserves the right to attempt to fix any reported issue before issuing a refund or credit.
The User must wait until TUNINGBOT resolves or formally declares the issue unresolvable.
9.5. Refunds or credits may be granted only if all of the following conditions are met:
- The claim is submitted within the 30-day period (Clause 9.1);
- The claim follows the ticket procedure (Clause 9.2);
- Adequate evidence is provided (Clause 9.3);
- TUNINGBOT acknowledges the issue in writing;
- The User has waited for TUNINGBOT’s resolution attempt (Clause 9.4).
9.6. Refunds are not available under any circumstances other than those explicitly described above.
